Ex-Convict Bags Jail Term...Months After Being Released From Prison For The Same Crime

An Osun State Magistrates’ Court sitting in Osogbo on Thursday sentenced an ex-convict, Femi Akinbo, to five years imprisonment without an option of a fine for stealing.

Akinbo, who confessed to the crime, had been convicted for stealing in 2019 and released after spending one year and three months in jail.

According to the police prosecutor, Kayode Adeoye, the defendant in December 2020 burgled the house of one Taiwo Afolabi at the Oke-Osun area, Osogbo, carting away four ATM cards, a sum of N227,000, a Tecno T35 mobile phone, and one Itel phone.

Adeoye said all the items stolen by the defendant were valued at N241,000.

According to him, the offences are contrary to sections 390(9), 412, and 411 of the Criminal Code Cap. 34 Vol. II Laws of Osun State of Nigeria 2002.

The defendant, who had no legal representation, pleaded guilty to the three counts of burglary and stealing.

Presenting the facts of the case, Adeoye tendered some of the stolen items before the court.

He also tendered the confessional statement of the defendant and told the court to note that Akinbo in 2019 served 15 months’ imprisonment at the Ile-Ife Custodial Centre for offences bordering on stealing.

The Magistrate, A. A. Adeyeba, found the defendant guilty of the charges and sentenced him to five years’ imprisonment without an option of fine.
